12 February 2009 I want to knnow that is it necessary to register the asset ( premises) in the name of the assess to claim depreciation as per I.T. Act. As per companies act substance over form concepts whether applicable or not. Actually To tax LTCG on sale of officepremises I want to increase the value of block by purchasing but the registration work will not b completed within such time

12 February 2009 In case of depreciable assets there is only STCG no LTCG.
yes u can claim depreciation if there are evidence that u r the enjoying the benefits of the asset
