Articleship working hours

18 June 2014 Hello, i have clared my IPCC both groups and currently doing my articleship in a
propritorship.
My working hours are 10-6 with a lunch break of 40 min. I work for 6 days a
week. Same timings are mentioned in my articleship registration form. As per my
knolwdege, institute's rule is that, an article should not work beyond 35 hours a
week in normal circumstances. However i am working alomst 42-45 hours a
week.
Also for any leave i take, it is deducted from my stipend.
Am i eligible for extra leave? Does the Principal have right to deduct it from my
stipend?
Also if i take the credited leave now, will i be eligible for leave during my bcom
and final exam?
Please, guide me about workings hours and leaves i can take.

My principle denies that i'm eligible for leaves for working beyond 35 hours.

18 June 2014 Thank you sir Will you elaborate about the proofs to be submitted to ICAI for claiming the credit of the excess hours worked in my 2 years of articleship.

We are maintaining attendance in register where there is only status of the attendance not the timing.

18 June 2014 i think approval from your principal is must and is the best proof u can have...

but one thing .. i dont know why u wants to credit those extra time....

generally many of the students does that even i too had done that for months regularly... but its the mutual understanding between me and my principal that i hadnt claimed excess time....

so think over this once again dear..........

18 June 2014 Sir My attempt is due in November 2014. I have not taken any class till date. When asked to the principal about the leave, he is allowing leave for only 1 month.

I have also requested him that if there is existencies of work i will shift my attempt to May 2015 and i will take leave from october onwards.
But he did not agree upon it alos.

19 June 2014 my dear friend... icai permit 3 months leaves for exam....

we cant do anything beyond than this...

its on u and him mutual understanding...

either u can join evening classes or week off classes...

my personal view is study is much important than articleship....

so try to convence your boss....

19 June 2014 I have tried all the things but he is not allowing.

What will be the consequences if i told to my principal that i can't work more than 35 hours in a week so that i can utilise time for my study.
