23 March 2025 Yes, subject to specific conditions. The Supreme Court of India has reinforced that any partnership deed that attempts to confer full partner status on a minor or imposes personal liability on them is invalid. This was upheld in cases such as Dwarkadas Khetan & Co. where it was clarified that minors can only be admitted for benefits, not full partnership rights.
According to Section 11 of the Indian Contract Act, a minor is not capable of entering into a contract. Therefore, any partnership agreement that attempts to grant full partner status to a minor is considered void and cannot be registered.
Any partnership deed that attempts to confer full partner status on a minor or does not comply with Section 30 of the Indian Partnership Act cannot be registered. Such agreements are deemed invalid under the law.
