MCA UPDATE:
MCA has issued Director (Appointment & Qualification) 3rd Amendment Rules, 2019.
Provisions of the Law:
1. WEB Service- DIR-3 KYC:
Web based e-form DIR-3 KYC shall be used by the DIN holder who has submitted DIR-3 KYC e-form in the previous financial year and no update is required in his details.
2. E-form DIR-3 KYC:
i. E-form DIR-3 KYC is to be filed by an individual who holds DIN and is filing his KYC details for the first time, or
ii. by the DIN holder who has already filed his KYC once in e-form DIR-3 KYC but wants to update his details..
Note:
A. As per Rule 12A of Directors KYC: Every individual who has been allotted a Director Identification Number (DIN) as on 31st March of a financial year.
Therefore, all the individuals who have obtained DIN on or before 31st March, 2018 shall have already filed their DIR-3 KYC in previous financial year.
Therefore for such individuals:
• If they want to update their details, will file e-form DIR-3 KYC.
• If the details are same as earlier filed in DIR-3 KYC, they will file web-based, DIR-3 KYC.
B. If an individual obtains DIN after 31st March 2018 till 31st March 2019, in this case, such individual shall file e-form DIR-3 KYC.
Due Date: This year the due date of filing both the DIR-3 KYC is 05th October 2019.
STEPS FOR FILING OF WEB SERVICE - DIR-3 KYC
STEP: I - Log In on MCA Website
Web service DIR-3 KYC is available in
• MCA Services
• DIN Service
STEP: II - Mention DIN No.
STEP: III - Mention DIN and submit Window for Mobile and Email OTP will appear.
STEP: IV - After submission of OTP, the filed form will appear. Click on Submit button and then confirm the same.
