Every year, lakhs of taxpayers miss the 31 July deadline because of a pending Form 16, a corrected AIS, or plain procrastination. The good news is that the Income-tax Act gives you a second window. The bad news is that this window has a cost, and it closes for good on 31 December 2026.
This guide explains the deadline, the exact penalty, what you lose by filing late, and what to do if even this date slips.

What Is a Belated Return?
A belated return is an income tax return filed after the original due date under section 139(1) but within the extended period permitted by section 139(4). Although the Income-tax Act, 2025 has come into force from 1 April 2026, AY 2026-27 continues to be governed by the Income-tax Act, 1961, so the familiar sections 139(4), 234A and 234F apply.
ITR Due Dates for AY 2026-27 at a Glance
| Taxpayer Category | Original Due Date | Last Date for Belated Return |
| Salaried individuals, HUFs and others not requiring audit (ITR-1, ITR-2) | 31 July 2026 | 31 December 2026 |
| Certain non-audit business and professional cases (ITR-3, ITR-4) | 31 August 2026 | 31 December 2026 |

| Transfer pricing cases | 30 November 2026 | 31 December 2026 |
Note: The CBDT extension for audit cases moves only the original due date. The outer limit for a belated return stays at 31 December 2026 for everyone.
Penalty for Belated Return: Section 234F Late Fee
Section 234F is a flat fee for default in furnishing the return. It does not depend on how many days or months you are late. Filing one day late or five months late costs the same.
| Total Income | Late fee u/s 234F |
| Up to ₹5,00,000 | ₹1,000 |
| Above ₹5,00,000 | ₹5,000 |
- The fee applies even if your tax is fully covered by TDS and you owe nothing.
- It applies only if you were required to file. A person with no filing obligation who files voluntarily after the due date does not pay it.
- The portal calculates it automatically. It must be paid as self-assessment tax before you submit the return.

Interest on Unpaid Tax: Sections 234A, 234B and 234C
The late fee is the visible cost. Interest is the running cost.
- Section 234A: 1% per month or part of a month on tax still unpaid after TDS, TCS and advance tax, counted from the day after the due date until the date of filing.
- Section 234B: 1% per month if advance tax paid is less than 90% of assessed tax.
- Section 234C: interest for deferment of advance tax instalments.

What Else Do You Lose by Filing a Belated Return?
The fee and interest are often the smaller problem. The bigger losses are these:
- Carry forward of losses: Business losses and capital losses of the year cannot be carried forward if the return is not filed by the due date. House property loss and unabsorbed depreciation can still be carried forward.
- Choice of tax regime: Individuals with business or professional income who miss the due date lose the option to opt out of the new tax regime for the year. Salaried taxpayers can still choose their regime while filing.
- Refund interest: Interest on refund under section 244A is paid only from the date you file, not from the start of the assessment year.
- Certain deductions and exemptions: Most Chapter VI-A deductions remain available in a belated return, but a few profit-linked deductions and exemptions require the return to be filed within the due date.
- Delayed processing and loan or visa paperwork: Refunds and ITR acknowledgements arrive later, which can affect loan approvals and visa applications.
- Prosecution risk: Wilful failure to file can attract prosecution under section 276CC in serious cases, so non-filing is never the safer option.
Can You Revise a Belated Return?
Yes. For AY 2026-27, a return filed under section 139(4) can be revised under section 139(5) up to 31 March 2027. Revisions made after 31 December 2026 attract a fee under the new section 234-I. Filing a correct belated return the first time still saves you time and cost.

What If You Miss 31 December 2026 Too?
After 31 December 2026, section 139(4) is no longer available. Your remaining option is an updated return (ITR-U) under section 139(8A), which can be filed within 48 months from the end of the relevant assessment year, but it costs more:
| When ITR-U is filed | Additional Tax on Tax and Interest Due |
| Within 12 months from end of AY | 25% |
| 12 to 24 months | 50% |
| 24 to 36 months | 60% |
| 36 to 48 months | 70% |
ITR-U generally cannot be used to claim a refund or to report a loss, so it is a poor substitute for filing on time.
