Updated Income Tax Returns: A Compliance Opportunity or a Costly Mistake?

An updated return (ITR-U) is a second chance that costs real money. It can fix a missed income item long after the normal deadlines, but the price rises the longer you wait, and filing it when a cheaper route exists is a common mistake.

Which law applies?

For AY 2026-27 and earlier, the provision is s. 139(8A) of the 1961 Act. From Tax Year 2026-27, it is s. 263(6) of the 2025 Act. In both, the window is 48 months.

Updated Income Tax Returns: A Compliance Opportunity or a Costly Mistake

Three corrective routes compared

Belated return Revised return Updated return (ITR-U)
Used when The original return was missed The original return had errors Income was missed or under-reported, or no return was filed
Governing section 139(4) (1961 Act); 263 (2025 Act) 139(5); 263(5) 139(8A); 263(6)
Time limit Within the statutory belated window Extended to 12 months from the end of the relevant year, with a fee in the later window Up to 48 months
Cost Late fee and interest Nil in the early window, then a fee Additional tax of 25% to 70% on tax plus interest
Can it reduce tax? Within general rules Yes No

How the additional tax works

The additional tax is a percentage of the aggregate of tax and interest:

Filed within Additional tax
12 months of the end of the year 25%
24 months 50%
36 months 60%
48 months 70%

Illustration. Missed income produces ₹3,00,000 of tax and ₹60,000 of interest, so the aggregate is ₹3,60,000.

  • At 25%: the additional tax is ₹90,000.
  • At 70%: the additional tax is ₹2,52,000.

All of it, tax plus interest plus additional tax, must be paid before filing.

For AY 2026-27 the last day for an ITR-U is 31 March 2031 , and the tiers fall at 31 March 2028, 2029, 2030 and 2031.

What the Finance Act 2026 changed

Commentary on the Finance Act 2026 reports two relaxations:

  • An updated return is now allowed to reduce a previously claimed loss , either converting it into positive income or reducing the loss.
  • An updated return can be filed even after a reassessment notice has been received, with an extra 10% added to the additional tax.

An ITR-U still cannot claim a refund or reduce your tax liability.

When it is an opportunity

  • Missed income: unreported capital gains, interest or perquisites you discover yourself, such as an ESOP perquisite not reflected in the return.
  • Non-filers: a missed return can still be regularised within 48 months.
  • Before the department finds it: filing voluntarily early costs 25% or 50%, which compares well with the 50% or 200% penalty regime for under-reporting and misreporting if the department detects it first.

When it is a costly mistake

  • A cheaper route was available. A revised return, now allowed for longer, carries no additional tax.
  • Waiting. Each year of delay raises the cost, from 25% up to 70%.
  • Underpaying. Tax, interest and additional tax must be paid before filing.
  • Trying to claim a refund or lower tax. An ITR-U cannot do this.
  • Forgetting to e-verify. E-verification within 30 days of filing still applies.
  • Missing the 2026 conditions. The loss-reduction and post-notice routes carry their own conditions, so check them before relying on them.

A decision framework

  1. Is a revised return still available? If so, use it.
  2. Does the fix increase tax payable? Only then is ITR-U the right tool.
  3. Calculate the 25%, 50%, 60% or 70% tier for the current date.
  4. Has a notice been received? Weigh the extra 10% against the penalty exposure.
  5. Pay, file and e-verify within 30 days.

Bottom line: an updated return is a tool for voluntary correction, not a general-purpose fix. Used early and for the right reason it limits exposure, but used late or for the wrong problem it multiplies the cost.
