About extension of Due date of INC 22A ACTIVE

Government has finally extended the due date of Filing INC 22A ACTIVE as officially confirmed by MCA. New due date of filing will be 15th June 2019 now. It may be noted that due date of filing of this form was 25th April 2019; failing to file could have entailed a penalty of INR 10000.

MCA has done so by issuing a Notification regarding Companies (Registration Offices and Fees) 2nd Amendment Rules, 2019.  Below is the screenshot of MCA circular issued in this regards.

This move from MCA was expected amidst all representations coming from various governing bodies including ICSI and state associations. This extension is sure to bring a sigh of relief for those who are yet to file their forms due to variety of reasons.

In an earlier announcement, MCA has published on its website that 'VPD service will be unavailable from 8:00AM to 08:00PM IST on 24th - 25th Apr 2019 for system maintenance. Stakeholders are requested to plan accordingly'. VPD is 'View Public Documents' Service. This has come into picture exactly at the time of due date of filing of INC 22A ACTIVE.

Now it is official that due date of form ACTIVE stands extended to 15th June 2019. This means that form INC 22A ACTIVE can be filed without any penalties upto this date. Also, MCA has clarified that INR 10000/- penalty shall apply if form is filed beyond 15th June 2019.

It may be noted that extension upto 15th June 2019 is on account of another due date of filing of LLP form 11 which is 30th May this year. This way, MCA seems to have avoided probable clash of both due dates.

It may be noted that LLP and foreign companies are not required to file INC 22A ACTIVE anyway.
