Residential status & taxation of salary income

Query Relating to Residential Status & Taxation of Salary Income:

What will be the tax treatment of Salary earned in Kenya by Mr. “A” whose residence status is “Resident & Ordinarily Resident” during the Financial Year 2011-12 & 2012-13.

  1. Mr. A went abroad first time during 2011-12.

  2. Whether salary received and remitted to India will be Taxable as per IT Act, 1956.

  3. Whether any relief is available against Tax deducted from salary in Kenya.

  4. If available, what is the procedure to claim relief.

if the person is resident and ordinary resident, then all income earned by such person in India or outside India is taxable in India.

But any Income earned outside India, either taxable in India or Outside India, once taxable then it will not be taxable again when it is remitted to India.

The sections 90 and 91 provides relief to person whose income is taxable in more than one country.
