Form 5inv

07 March 2014 Sir,
Ours is a Private Limited Company, we have share Application money pending for allotment but not pending for refund, we don't have any unclaimed/unpaid dividend but we have received notice to file Form 5INV.Is it required to file Form 5INV ?
Please clarify at your early.

07 March 2014 Yes, the company has to e-file From V INV for the share application money pending for allotment. If the same is pending for more than seven years money has to be deposited to IEPF . The amount, if any, so deposited is irrecoverable.

It is due for allotment but not for refund right? So, I think its not compulsory to file Form 5INV as it is Private company, need not allot the shares with in time limit prescribed..
It applies only to the Public companies.
Pl clarify at ur early




08 March 2014 Form 5 INV applies to all companies. This form is only to reflect the outstanding amounts. it doesnt mean that you are required to refund.

The Amount is pending for allotment but not due sir,
and even in the FORM 5 INV, We dont have any option as share application money pending for allotment.

if the there absolutely nothing eligible for refund, then you may not file as the form itself wont allow to be validated with zero totals.
