Wheterh service tax & VAT both is applicable on softwares? If yes, on what value ST & VAT would charge and can i get credit on such ST/VAT?

The ready to sell software in physical form is only to suffer VAT/ CST.
The electronic download however is being sought to be clollected by the state as well as the centre in the form of servic etax.
In my view the liability under VAT exists as confirmed by TCS case. Liability under ST may not exist as it would be struc\k donw in due course of time.
