Dear All

We have Central excise register hold & now we have exporting our goods Under Rule 18  trough central cxcise sealing 

 Now central excise people telling self sealing is mandatory, as per  a circular no. 860/18/2007-CX dated 22-11-2007   we are not attending your export sealing

Central Excise Sealing required for me what can we do please guide me any one

CBEC directed field formations to insist self-sealing if the export is not under any incentive scheme. Discuss with your AC for help.

Goods can be cleared from factory duly sealed. Goods can be cleared for export without sealing also. Any manufacturer-exporter can clear export consignment with self-sealing and self-certification- CBEC circular No. 736/52/2003-CX dated 11.8.2003. In certain cases self-sealing is mandatory.  Self-sealing are compulsory for self-sealing in case of free shipping bills, non-excisable agricultural products, third party exports and merchant exporter.

Dear Mr. Arun Kumar, I want to export to Turkey. Now I have LUT against which i have to export. We have no factory stuffing permission from AC. AC advice us for self sealing. We want to export against advance licence and export incentive also. Will you kindly advice us that if we stuff the container our-self what about the incentive and other.

When the export consignment is cleared from factgory under any obligation due from DGFT or customs, it is always better to get it stuffed and sealed by Suprintendent of central excise, coz at the time of documentations at customs/ dgft couple of times the declarations of ARE-1, part A, sl no 3 is duly certified by supt of excise is needed, without which the process would get halt, and in case of self sealing supt may deny to issue such certificate seperately. coz he is not signing the ARE-1

Any manufacturer-exporter can clear the goods for export consignment with self sealing and self certification. If you want to export against advance licence you will not get any export incentive. Stuffing of containers inside the factory, under supervision of central excise officers is permissible. Pre-shipment quality inspection, where required, should be carried out before stuffing. The superintendent of central excise shall send an examination report of factory sealed packages/containers to the port/airport of export.
