11 February 2013 We are manufacturers of coated polyester film. We sold nearly 18.00 lacs material against form C. Now the party is not responding for form C. He says he will not co operate and issue form C.
In this cas our local consultant advises to raise differential debit note and claim difference with interest.

We wish to know if we can inform local Vat divison or the Vat divison of his state and initiate some pressure to get C form released or any provison in CST law to raise pressure?

11 February 2013 No, commercial tax department will not interfare in such cases. Legally you can ask for differential tax in case C form is not issued within 3 months.
You can file a court case for recovery in case customer is not willing to pay the differetial tax amount.

Sale tax deptt will not help
and if you issue debite note, then as you say party will not cooperate , then will they accept these debite note and will pay?
I don't think so
so only way is ask them to cooperate
otherwise last option is court,
but in practical, it took very long time till sales tax deptt will ask you to pay full tax
