  • vijay says : salary paid to foreigner
Can you suggest me the treatment of given below:- If an Indian Company appoint Foreigner (from Spain) as an employee by appointment letter (currently for six months but it to be continued if its work is satisfactory) from 1st April, 2010. His salary fixed as per contract for Euro 1500 per month (salary paid in foreign currency by wire transfer). He stayed & worked in India (accommodation provided by company for two months in a hotel & after in a rented house & rent paid by company). What is the treatment as per Indian Income Tax (TDS) & DTAA. Can we treat Resident or Non-Resident? Note: - Company wants to make payment for two months salary in foreign currency but he is not having PAN till date. He would be applying for a PAN card after salary received for two months. In this condition what is the treatment of TDS whether it is 20% or 10+20+30 as per tax slab. Sir, kindly suggests me the best & simple option with Example. Vijay Kishore Sharma
