1) Can I Change or Amend the Trademark Name After Registration?

No. Once a trademark is registered, the word/name/logo itself cannot be changed, modified, or altered. If you wish to use a new or modified brand name/logo, you must file a fresh trademark application for the new mark.

2) Can I Change the Logo After Registration?

No. A registered logo cannot be changed.

Reason: Registration protects exactly what is filed, not its updated version. For a new logo design, file a fresh application.

3) Can I Correct Spelling or Minor Errors in the Mark?

Only very minor, non-substantial corrections are allowed under Rule 37 through Form TM-M, such as:

  • Deleting a small element
  • Rectifying clerical mistakes
  • Adding disclaimer details

But no substantial change to the mark's identity is permitted.

4) How to Change the Name of the Trademark Owner After Registration?

A change in ownership details is allowed, but the trademark itself does not change.

In case of:

a) Company Name Change - File Form TM-P with:

  • ROC Name Change Certificate (INC-24/INC-25)
  • Board Resolution
  • Updated company documents

b) Partnership Firm Name Change - File Form TM-P with:

  • Partnership Deed showing revised firm name
  • TM-P application

c) Individual Name Change - File Form TM-P with:

  • ID proofs
  • Gazette notification (if applicable)

5. How to Change the Address of the Proprietor?

File Form TM-P with updated address proof (GST, utility bill, lease deed, etc.).This does not affect the trademark itself.

6. Can Ownership of a Registered Trademark Be Transferred?

Yes. A registered trademark can be:

  • Assigned (fully or partially)
  • Transferred
  • Licenced
  • Franchised
  • Passed on during merger/acquisition
 

Procedure:

  • Execute Assignment Deed
  • File Form TM-P
  • Registry endorsement required

7. How to Add or Change the User (Licensee / Permitted User)?

To record a permitted user:

  • Execute Licensing Agreement
  • File Form TM-U
  • Registry endorsement required

8. Can I Add More Goods/Services After Registration?

No. You cannot expand the specification of goods/services after registration.For new goods/services, file a new trademark application under the relevant class.

9. Renewal of Registered Trademark

A trademark is valid for 10 years, and must be renewed every 10 years.

Renewal steps:

  • File Form TM-R
  • Pay government fees
  • Renewal certificate issued

Late Renewal:

Allowed up to 1 year after expiry upon payment of surcharge (Restoration + Renewal).

Fees:

If Renewed within the period, then only the normal renewal fee i.e. INR 10,000/- (INR 9,000/- if filed online) will be levied.

Further, if trademark is not renewed within the valid period and file application up-to six month from the expiry of trade mark then further fees of INR 5,000/- (INR 4,500/- if filed online) will be levied extra. (I.e., - Original renewal fees INR 10,000/- plus extra INR 5,000/-, if filed physically)

Further, if trademark is not renewed within the six month from the expiry of trade mark, and file application after six month but before one year from the expiry of trade mark, further fees of INR 10,000/- (INR 9,000/- if filed online) will be levied extra. (I.e., - Original renewal fees INR 10,000/- plus extra INR 10,000/-, if filed physically)

 

10. What If I Forget to Renew the Trademark?

Your trademark may be marked as:

  • Expired
  • Removed from register

You can still restore it within 1 year from the date of removal by filing TM-R for restoration.

11. How to Get a Duplicate Registration Certificate?

If the certificate is lost or misplaced:

  • File Form TM-M
  • Pay fee
  • Provide undertaking for loss
  • Registry will issue a duplicate certificate

12. How to Update Contact Email or Mobile Number?

Use Form TM-M with:

  • Correct email
  • Correct phone
  • Authorization letter (if agent/attorney updates)

13. What If Someone Is Infringing My Registered Trademark?

You may initiate:

  • Civil action: injunction + damages
  • Criminal action: police raid, seizure (counterfeit cases)
  • Customs recordal: stop import of infringing goods
  • Cease & Desist notice

Having a registration certificate significantly strengthens enforcement.

14. Can I Add Color Claims Later?

No.If your mark is registered in black & white, it covers all colors. But color cannot be added or claimed later.To protect color-specific branding, file a fresh application in that color combination.

15. Can Two People Co-Own a Registered Trademark?

Yes, provided:

  • They file jointly
  • A joint ownership agreement exists
  • Future use rights are clearly allocated

Any transfer of share requires Form TM-P.

16. What If the Registered Trademark Is Not Used?

If unused for 5 years + 3 months, any third party may file a:

  • Cancellation petition under Section 47
  • Before High Court / Registrar

Important: Maintain evidence of commercial use.

17. How to Record Trademark as a Business Asset?

Trademark can be:

  • Shown as an intangible asset in financial statements
  • Valued for funding or M&A
  • Mortgaged/hypothecated
  • Licensed for royalty income

Assignment allows transfer of rights.

18. Can I Modify the Trademark Logo and Use It Without Re-filing?

Yes, you may use a modified logo, but:

  • It will not be legally protected
  • Old registered version still stands
  • For protection, file a new application for modified logo

19. What If My Registered Trademark Is Opposed or Challenged Later?

Even registered marks can be challenged via:

  • Rectification
  • Cancellation
  • Invalidation

Keep strong evidence of continuous use, promotion, invoices, GST entries, etc.

20. Do I Need to Record Renewal or Assignments Internationally?

For trademarks registered abroad:

  • Each country must be updated individually OR
  • Use WIPO/Madrid Protocol for centralized changes (for Madrid marks)
