Sub: Extension of last date for filing of form MGT-7 (Annual Return); AOC-4 (financial Statement) under the Companies Act, 2013
The Ministry of Corporate Affairs vide its notification dated August 28, 2015 amended the provisions of the Companies (Management and Administration) Rules, 2014 and brought out e-form MGT-7 for filing of Annual Return. Also MCA has vide notification dated September 4, 2015 brought Companies (Accounts) Second Amendment Rules, 2015 wherein Form AOC-4; Form AOC-4 CFS (consolidated financial statement) and AOC 4 (XBRL) made available for filing.
On July 13, 2015, MCA vide General Circular No. 10/2015 has relaxed the filing of Form MGT-7 and AOC-4 without additional fee upto 31st October 2015.
In this regard, we wish to submit that we are receiving lots of concerns which are being faced by corporates and practising professionals in filling and filing of these forms, relating to validation issues on AOC-4 and AOC-4(XBRL). As your goodself has recently released the validation tool for XBRL filing, the issues pertaining to all other related forms are yet to be settled and subject to changes in their version.
Sir, it is humbly submitted that the last date for filing of these forms i.e. MGT -7, AOC-4; AOC-4 CFS and AOC 4 (XBRL) be further extended till December 31st, 2015, considering the practical difficulties, being faced by the stakeholders.
