Partnership

This query is : Resolved

21 January 2016 Can there be any clause in partnership deed that any one partner can expel other partners whenever he wants.

26 January 2016 Partnership is by mutual consent of partners. Partners are not employees to expel by another partner. Any inclusion of such clause in violation of the Partnership Act, 1932 voids the contract / agreement of partnership.

Please refer section 33 and 32 of the Act. Deed cannot make only one partner liable for expulsion but deed can make it applicable of such expulsion terms equally to all the partners.
