Gratuity payment

16 September 2014 Dear Sir

After 16 years service I resigned from company a year back. Even after one year, company has not paid my gratuity amount nor given calculations statement.

Is there any rules which ensures gratuity payment within specific period. Does company liable to pay interest in case of delay. If company do not pay this to whom the complaints can be made.Please advise.

16 September 2014 1. it is to be paid within 30 days from the date it becomes payable to the person to whom the gratuity is payable. Refer Section 7(3) of the Payment of Gratuity Act, 1972

2. failure to pay within 30 days attracts penal interest under 7(3A)

16 September 2014 where employer doesn't pay you need to complain to controlling authority prescribed in the Act referred to above.
