When arbitration proceeding is pending can winding up petition be filed in the court? Suppose X company has to pay Rs--and case is filed under arbitration clause for the claim and while arbitration proceeding is pending can we file winding up petition in High Court? Pls suggest me any case law on this or article Urgent reply is sought

rohit verma ( Author ) 22 July 2011 hi friends i am serving my last 3 months of articleshipand my principle is forcing me to take transfer otherwise he has said that he will terminate me by putting any reason i am in ca final and going to fill form of exam nearly so please help me and tell the process .i know that vide announcement of 12.05.11 of institute that before taking transfer or termination institue approval is necessary,so what i have to do in this situation help me i think i have excess leave of 1 months in my hands so can this leave set off in my remaining period of articleship

Respected all, Can anybody tell me whether charge is required to be created with the ROC even if the Banker does not insist. Our company had filed form 8 after 60 days with ROC and paid filing fees also in the year 2008.But charge is not created.Now the ROC has sent a mail stating that your form 8 is pending that too after 3 years.we have already repaid full amount of loan. what course we need to take now.whether we need to go to CLB?what would be the penalty if we go for compounding? as loan is laready paid and charge is not created whether we require to go to CLB now? urgent reply is sought from our friends

Sir, MCA has published a list of defaulters and our company is one among them. We would like to apply under fast track exit mode to srike off our company.Is it mandatory that before applying we need to file balance sheet and profit and loss account to remove from defaulter list and then file application under fast track exit mode. reply is urgently sought
