Dear Huzaifa, Please suggest me on the following :- We filed IT retun of AY 11-12 without claiming depreciation deduction in the form and deposited tax on 55 lakhs (Pr. after dep) (and dep is 25 lakhs). We got a notice of demand stating income as 80 lakhs and asking for income tax accordingly. Now i want to ask if it is possible to get the deduction of depreciation? can you quote a case law? we have filed appeal with CIT (A) but he is saying that depreciation cant be allowed.
