Hi!

I am Sanjay Gupta from "City of Joy - Kolkata". I have completed ICWA, M.Com, CS, DIM and currently pursuing MBA. Presently i am working for Hindustan Aeronautics Limited, Barrackpore Division as a Dy. Manager (Finance). Prior to this, for last 3 years i worked for "West Bengal Industrial Development Corporation Ltd" as Officer On Special Duty and before that for 3.5 years i worked for "Jekay Group of Companies" as Manager (F & A).

I am a part of caclubindia Family to share whatever knowledge i have and also to enhance my own knowledge. We all learn something everyday, because education never ends be it in school, college, institutions or in Journey of Life.

Plz clarrify me as per Explanation of Section 140A:- Where the amount paid by the assessee under this sub-section falls short of the aggregate of the tax and interest as aforesaid, the amount so paid shall first be adjusted towards the interest payable as aforesaid and the balance, if any, shall be adjusted towards the tax payable. Is the Same concept be used in case of multiple refunds from the Income Tax Department.

Dear Sir, Can you provide the provision of Central Excise Cenvat credit on FOC(free of cost) material its not sale for us.matter as follows: We are service provider for civil construction and instalation. one of our customer supply material(cement, steel bar like) on FOC(free of cost) and provide us Excise Invoice.customer is a register dealer in excise. 1)Can we avail CENVAT credit on FOC material(cement, steel like), 2)what is effect of AP VAT of FOC material, 3)what way we show the material in books of account if CENVAT credit avail.
