I have failed to file annual return for one my clients private limited company for p.y 13-14, is penalty payable as per new act or old act and guide me also about company law settlement scheme 2014 and how can i avoid such penalty??

1. Initially penalty is not payable, but additional filing fee has to be paid.
2. Fee is calculated as per 2013 Act.
3.Please file the forms now. System will generate fee for the amount payable after automatically availing CLSS,2014 benefit.

you mean to say I should file e-form clss to avail benefit, for the time being , after filling the same it will let us knw amount payable?ryt?

may i have reason for fees as per new act coz for annual forms still 1956 is applicable which includes provision for fees as well,ryt??please guide

Annual filing forms has to be filed first. Then if CLSS,2014 applies in your case, file e-form CLSS 2014 for getting immunity certificate.
Please note that CLSS,2014 can't be availed for filing those forms whose due date falls after 30.6.2014.
