Utilisation of Input Tax Credit

UTILISATION OF INPUT TAX CREDIT – Section 49A & 49B read with Rule 88A of CGST ACT.

CGST Amendment Act 2018 insert two new sections Section 49A & 49B containing new order of set off of GST liability (from 1st Feb 2019). Prior to this Section 49(5) of CGST Act contains the manner of utilization of ITC. Let’s read both old and new provision with help of an example.

SECTION 49(5)- The amount of input tax credit available in the electronic credit ledger of the registered person on account of:

i) Integrated tax shall be first utilized towards the payment of integrated tax and remaining amount may be utilized for payment of central tax and State tax or Union territory tax, if any.

ii) The central tax shall be first utilized towards the payment of central tax and the remaining amount may be utilized to pay taxes towards the integrated taxes.

iii) The State tax shall be first utilized towards the payment of State tax and the remaining amount may be utilized to pay taxes towards the integrated taxes.

iv) The Union Territory taxes shall be first utilized towards the payment of union territory taxes and remaining amount may be used to pay toward integrated taxes.

v) The State tax or union territory tax shall not be utilized towards the payment of central tax or vice-versa.

vi) Any balance in the electronic cash ledger or electronic credit ledger after the payment of all taxes, penalty, fee, or any other payable amount may be refunded to the taxpayer as per provisions under section 54 of GST Act.

Now with the introduction on 49A & 49 B in CGST Amendment Act 2018, the Order for availing the set off of ITC has been changed w.e.f 1st Feb 2019.

'Utilisation of input tax credit subject to certain conditions'

'49A. Notwithstanding anything contained in section 49, the input tax credit on account of central tax, State tax or Union territory tax shall be utilised towards payment of integrated tax, central tax, State tax or Union territory tax, as the case may be, only after the input tax credit available on account of integrated tax has first been utilised fully towards such payment.'

'49B. Notwithstanding anything contained in this Chapter and subject to the provisions of clause (e) and clause (f) of sub-section (5) of section 49, the Government may, on the recommendations of the Council, prescribe the order and manner of utilisation of the input tax credit on account of integrated tax, central tax, State tax or Union territory tax, as the case may be, towards payment of any such tax.'.

THIS NEW ORDER OF SET OFF IS RESULTING IN BLOCKAGE OF ITC OF SGST & CGST, RESULTING IN PAYMENT OF TAXES BY TAXPAYERS.

TO CURVE THIS - The new order of ITC utilization rule 88A is brought vide Notification no 16/2019 dated 29-03-2019 made effective from the 1st April 2019.

Let us analyze the changes that are being brought by the new order of utilization vide rule 88A by the power conferred to the government vide section 49B.

'Rule 88A.' Order of utilization of input tax credit. -

'Input tax credit on account of integrated tax shall first be utilised towards payment of integrated tax, and the amount remaining, if any, may be utilised towards the payment of central tax and State tax or Union territory tax, as the case may be, in any order'

'Proviso to Rule 88A'

‘’Provided that the input tax credit on account of central tax, State tax or Union territory tax shall be utilised towards payment of integrated tax, central tax, State tax or Union territory tax, as the case may be, only after the input tax credit available on account of integrated tax has first been utilized fully.'

As per the latest amendment, the order of utilization after the setoff of IGST liability was compulsory CGST and then SGST/UGST. Now the order has been relaxed wherein either of CGST or SGST/UGST liability can be set off.

IGST liability will be settled off first compulsory and then free to use IGST Input in either of the payment CGST or SGST/UGST liability in any order.

Some important points to be kept in mind-

  • ITC of IGST should me utilised in full before utilizing any other credit.
  • Taxpayers should note that Utilization of IGST ITC shall be allowed only when IGST liability has been fully paid first. After using it for IGST liability, it can be used for any other tax liability.
  • With the introduction of this rule, the taxpayer can adjust IGST ITC remaining after adjusting IGST liability with CGST/SGST/UTGST as per their discretion.
