A party has submitted invoice for Proessional sevices provided - for Securitu Guard Service provided
But they didnt have Service Tax on bill,
then while this making payment of this bill, Should I deduct TDS on it ???
Bill amount is Rs.7000/- for month, it is started from Dec-11
Dear Friend,
TDS deduction doesnot depend on the service tax charged. some times the party may have income less than Rs.10 lakhs so he may not have charged service tax. so tds to be deducted.
But in your case the service is covered under 194C, so neednot be deducted if the amount does not exceed 75000/- per year. So this year TDS need not deducted but in next year if serviced for full year at same rate then has to deduct in the next year.

TDS CAN BE DEDUCT ON CONTRACT SERVICES IF THE SINGLE PAYMENT IS MADE MORE THAN 30000 OR AGGREGATE 75000
