Companies Act, 2013 prescribes through section 39(4) that whenever a company having share capital makes allotment of securities, the company shall file the return of allotment as prescribed. The company shall file Form PAS – 3 within 30 days of the allotment of securities on the MCA portal. Here, the process of Right issue should be carried on as prescribed and then new e-form PAS – 3 is required to be filed with MCA.
