sir my income is below 250000 and i also have TDS refund about Rs.3500/- I want to do return file then the fine u/s 234 is mandatory to pay.

If Your "GROSS TOTAL INCOME" ID Below 2.5 Lakhs then sec 234F is not levied...
You can file without penalty and Claim refund for Your TDS amount.
