Eligibility of gratuity

Hello All,

I am posting for first time and hope I have selected correct category and sub category.

My question is about my eligibility of Gratuity. I am working with company for more than 6 years but with break of 2 months. I will describe my tenure in more detail as below:

- I joined the company on 23rd Jan 2008

- I resigned from the job in 2010 and my last day of work as 31st Aug 2010.

- I rejoined the same company(same employer) again after 2 months on 10th Nov 2010. In these 2 months gap, I was not working.

 - I am today (11th June 2014) working in the same company. So from 23rd Jan 2008 to today, its more than 5 years.

So, I would like to know whether I am eligible for Gratuity??? I initially was sure that I am not eligible but after reading FAQ4 in following link, I am confused.https://hrsuccesstalk.blogspot.in/2013/03/13-facts-one-should-know-about-gratuity.html

Dear Sir,

There is no need for confusion you are not eligible because you have not putup continuos service of 5 years to become eligible for gratuity.

In case your employer is kind enough to give you authorised leave for the period 01-09-2010 to 09-11-2010 and maitain your name on the rolls of the company then you are eligible for gratuity.
