Co Act 2013 580 views 1 replies

Dear Mam/Sir,

We are unable to decode , the Section 403 of the Companies Act 2013. As first proviso said , that Company have to filed to respective form within the 270 days from the date by which form should have been submitted, filed or recorded as the case may be with an additional fees as may be prescribed. Meanwhile second proviso is also there , for filing, recording or submitting.

Now question arises  that, "Is Company should cross the limit of 270 days again after the complition of first proviso?" "Or do Company should file forms after the 270 Days from the date by which shoul have been?"

Pls help on this matter.

Dear Rachana,

As per my understanding, Section 403 says as correclty said by you that forms should be submitted within 270 days with prescribed fees and additional fees as prescribed

Now 2nd proviso says that in case 270 days have left than also forms needs to submitted with prescribed fees and additional as applicable without any prejudice to any other legal action

regards
