DEAR VIKAS,
YOUR QUERY AS GIVEN:-
QUERY-1 I could not produce my rent agreement in time, my employer has not included any HRA exemption u/s 10 (13A).
MY ANS-1 MY OPINION NOT MANDATORY PRESENT THE RENT AGREEMENT TO THE EMPLOYER BECAUSE IF WE PAY RENT. THEN WE CAN CLAIM HRA exemption u/s 10 (13A) AT THE TIME OF FILING OF RETURN.
METHOD FOR CLAIM HRA- 10(13A)
1- Actual house rent allowance received from your employer
2- Actual house rent paid by you minus 10% of your basic salary
3- 50% of your basic salary if you live in a metro or 40% of your basic salary if you live in a non-metro
Out of above three which ever is less,alloweded as deduction
*Salary means FOR POINT 2 & 3 (Basic + D.A + Commission based on fixed percentage on turnover).
*Metro City :Delhi, Mumdai, Calcutta & chennai

Please clarify if I can do the exemption u/s 10(13A)during my ITR filing?
MY ANS-2 YES U CAN CLAIM HRA 10(13A)
Query-3 my tax consultant tells me that employee can claim only under 80GG, and not section 10 (13A). Is that correct? If employee does not submit rent receipt in time, then does he lose the benefit of section 10(13A)? Please clarify?
MY ANS-3 (x) If employee does not submit rent receipt in time, then never lose the benefit of section 10(13A) can claim in itr.
(y) 80GG ONLY FOR THOSE EMPLOYEE THOSE SPECIFICALLY NOT GET THE HOUSE RENT ALLOWENCE BUT PAY RENT FROM POCKET.
