Applicability of esi act for an organisation

Dear All,

A company registered in West Bengal has 22 employees with salary of more than Rs.15000/-.

A) I would like to know whether the company is liable to register itself under ESI Act. If so, kindly refer the case law.  

B) Will it be same for company having 22 employees and out of them 13 employees are drawing salary of Rs. 15010/-

A) I would like to know whether the company is liable to register itself under ESI Act. If so, kindly refer the case law.

 

Ans : No, company is not liable in this case, but the day company hire an employee getting salary less than 15,000, require to get it regisrered immediately.

 

 

B) Will it be same for company having 22 employees and out of them 13 employees are drawing salary of Rs. 15010/-

 

Ans : Yes. Excluded Employees (Salary >15000) are also counted for the purpose of applicability.
