UAE DTAA

for uae resident as per article 13 of the dtaa between India and UAE.capital gain from the sale of mutual funds are taxable in the UAE. but in UAE nothing of such income taxable. so ultimately it is an exempted gain. so how can I claim it in my return?

It is exempted only to UAE resident. In case of Indian resident it is taxable in India.

yes I am talking about uae resident......but what if TDS has been deducted and wants to refund the same....?

File ITR 2 and disclose the income under exempted income others.

Disclose the income under respective capital gains instead of exempted income as suggested above. Claim exemption in A7/B9 of return.
