This query is : Resolved

16 November 2013 Whether Provident fund institution are require to file income tax return? if yes then which ITR form applicable and under which section its given that to file ITR? in income tax act, 1961 they just mention fund or institution. they have not specifically given. and if its ITR-7 then under which clause. because even in ITR-7 nowhere its mentioned. pls clarify with detailed explainantion

18 November 2013 I don't know what you both did finally, but I don't think ITR 7 applies to recognized provident funds. Actually provident funds are not required to file income tax return as their income is totally exempt under Section 10(25).

They normally file return only to claim refund of TDS wrongly deducted on interest. So in such cases you may file ITR5. Please refer http://taxguru.in/income-tax-case-laws/belated-filing-return-ground-denying-income-tax-refund.html
