Notice of demand u/s.272(b)(2) provision of 139a

19 January 2012 With reference to the Above Subject, I filed my IT Returns for the A.Y.2009-10 & 2010-11 with Claiming Refund Rs.647 and Rs.7745 filing date 30-6-2010

as i waited for 1 year for refund and than started query with IT office first orally and than started filing letters To ITO and than ACIT,

Even i Did not Got my refund, So as per Expert advice, i filed RTI Application.

Instantly i got reply from ITO informing me that i have wrong Pan and opportunity of hearing is also provided U/s.272B(2) provision of Section 139A

as i verified my ack copy and replied Jumbling mistake happened by me i wrote 6615 instead of 6651


still i not recieved the refund so i again filed a letter to ACIT and ITO But this time i Copied format from somewhere in net and Changed all requirements but Instant of My Pan i filed a letter with others Pan


as i visited IT office for Query they said
i have to pay penalty for rs.10000/-

My annual income is only 60000 rupees and i have not done willingly

Please suggest me whom shall i approach and what should I do.

You know that Refund means Lakshmi.
.
For getting something one has to sacrifice something.

At least we have to accept our mistake. Write one more letter, accepting the mistake done by you in quoting the PAN.
You may also write that this is an unintentional mistake. Also attach xerox copy of your PAN by mentioning correct PAN this time.
Explain your financial position and request the AO or concerned clerk for issuing the refunds.
Just by the word of mouth penalty is not imposed. If you have not received any show cause notice, it can not be levied.
They are just showing importance of power.
You may politely present yourself and may get done the work.
