Income tax rule regarding receving of due salary

This query is : Resolved

01 November 2011 Respected Sir / Madam,

My friend is a government employee. He joined the service on previous Financial Year 2010-2011. But no salary was given to him. Now in current financial year 2011-12 office give him his due salary of f.y. 2010-2011 in lumsum. In last year as his salary was no much so he was not in the liable to pay tax. But office has count his last year salary with his current one and deducting tax on it. But he has not received any salary last year so why they are merging his last year salary with current one. What the income Tax rule say about it. If he can get some relief.

Thanking you in advance. Plz reply as soon as possible because it is urgent.

01 November 2011 In any financial year, if salary of more than 12 months is being given to the assessee, he can claim relief U/s 89.

If the assessee is not having any other income in the earlier previous year he can certainly claim tax relief as there will be no tax on salary of part of the year.
