19 November 2017 Hi, We are having small equipment installation order from Orissa. We are not Regd there.We are from MH.We engaged local contractor at Orissa to complete the job ,He billed to us at MH in IGST .
My question is that whether he can charge IGST in bill & can we take credit ? Or he should charge CGST SGST in bill ?
Please elaborate with provisions of GST

19 November 2017 Yes... You can take ITC for the IGST Tax.... No... He can't charge CGST and SGST.... Please refer sec 10 of the IGST Act...

20 November 2017 Dear Raja ji, the place of supply of service & locations of supplier is Orissa state. But Service receiver is in Maharashtra.that why this question is arises. We are afraid to take IGST credit. Somebody told that this transaction is CgSt SgSt, Sec 12 of IGST

20 November 2017 You are the Supplier of Services. The Sub-contractor ll be served for receiving instructions from You. This is the details in sec 10 of IGST act... Sec 12 if IGST act says the location of supply of services and provider in the states
