06 August 2008 How can an assesse claim the benefit of the HRA if the employee pays rent & get HRA from company but company deduct the excess tax as assesse has failed to give Rent Recept to Employer? How it should be claimed in ITR 1

07 August 2008 make a computation of total income then fill the ITR 1 . only gross income will be shown in ITR 1. HRA will be exempt U/s 10(13A) which is income exempt and do not part of total income.

07 August 2008 Even in this case the assessee must have actually paid rent and should be prepared to submit if demanded.

07 August 2008 if you show in your declaration to the company that you are paying tax and submitted the receipt at the year end then in no way company can deduct excess tax.
you can claim HRA at the time of filing of ITR I
