Dear Sir, Yesterday we have made some purchases from WOODLAND showroom in Dehradun under a offer of 40% flat discount. when they have billed the amount, they have charged separate VAT @ 5% on the discounted price. My queries are: 1. If the MRP of the product is inclusive of all taxes they how they can charge a separate VAT on the discounted price. Discounted price already includes proportionate VAT for the Sale Value. 2. while asking for the same they have shown us a letter duly signed by the Delhi based Advocate clearly mentioning therein that it is permissible as per law to charge VAT on Discounted price to the extent to total of the discounted price and the VAT charged on that does not exceeds the actual MRP. 3. Is there any notification/ clarification under Uttrakhand VAT tax for the same. 4. Can we file a complained against the WOODLAND or Shopkeeper, if Yes, where or how. Please advice CA Jitender Kumar
