What is the Bankers' Books Evidence Act, 2026?

The Bankers’ Books Evidence Act, 2026 replaces the colonial-era Bankers' Books Evidence Act, 1891, which governed the admissibility of bank records as evidence in legal proceedings for over a century. The new law has been introduced to align evidentiary rules with the realities of digital banking and electronic record-keeping.

The legislation recognizes electronic and digital banking records as admissible evidence, subject to prescribed safeguards relating to authenticity, integrity, and protection against tampering. It also provides a clearer framework regarding when courts may require production or inspection of banking records.
