Can we adjust excess TDS paid U/s 194C with short TDS paid U/s 195 ?

An individual purchased database from an US company. Is TDS applicable???

what is the rate of  TDS, if a co. registered in USA and provide advertisement services in india,,,,,and another co.who is agent of that co. in india and  collects payment on behalf of that co.
