Hi,

It is normally understood that the Bills on which Service Tax has been charged are subject to TDS.

Should we deduct TDS on telephone bills raised by Airtel on my Company?

Any refrence to Book (other than Act), case law, logic or agrgument for not deducting TDS on Telephone Bills?

You can refer views of Madras High Court in case of Skycell Communications Ltd. & anr. Vs. Dy CIT & Ors. (251 ITR 53). It is held that mere collection of ‘fee’ for use of a standard facility provided to all those willing to pay for it does not amount to a fee for technical services. It is not a fee merely because hi-tech communication technology is used for providing these services. In fact, it is a charge for use of a facility. Hence, TDS is neither deductible u/s.194C nor u/s. 194J.

There is not TDS on Telephone billss for a company.....

otherwise ... first f all think what head will u cut the TDs in ???.. u will get the clearance...

TDS is applicable only as per section,,,,,,,,,,,,so tds on telephone bill in not to be deducted,,,as no section is applies to it.........

No! I don't think TDS is applicable on Telephone bills or electricity bills! I have not seen my firm's clients deduct it! as it is not a contratual obligation and the bill amount basically comprises of charges of the calls being made which is not covered by the TDS regulations! But i'll get back to you with the proper details!
