I run a digital agency (partnership firm) and recently completed a web development project for a client, (charged 40,000 and not collecting GST ) and wanted to know if TDS is mandatory to deduct and if so what % ?

yes since it's professional work TDS under 194J @ 10% us required to be made by the paying party.
