Regarding capital gain tax

If I am doing btst (buy today sell tmrw)trades it comes under speculative business income or short term capital gain tax(for tax purpose)

As it won't come into demat

anything you sell it before it actual delivery is called speculative business. your business is totally speculative in nature and you are liable to Tax under the head profit and gain from business or profession. in one the judgement of the court the court said that investor need to keep the security at least one month in his Demat account or otherwise to be chargeable under the head capital gain
