Quick Summary
Long-term capital loss on Tata Capital shares can be claimed only after the shares are sold. The loss is computed using the actual purchase cost and sale price. Keep purchase records, bank payment proofs, demat statements, and sale contract notes to support the claim in your ITR.

When i can see the shares to book long term capital loss?
What are the documents needed to claim the long term capital loss?

Rajesh, a few key points on your situation:

HOLDING PERIOD: You purchased in January 2025 and the current date is July 2026, so you have held for approximately 18 months. For equity shares listed on a recognised stock exchange, long-term status requires holding for more than 12 months. Since your shares are now listed and you have held them for over 12 months from original purchase, a sale today qualifies as Long Term Capital Loss (LTCL), not short-term.

COST OF ACQUISITION: The FMV grandfather clause under Section 55(2)(ac) does NOT apply to shares newly listed after January 31, 2018. It only benefits shares that were already listed as of that date. For your Tata Capital shares, the cost of acquisition for LTCL calculation is your actual purchase price: Rs 10,60,000.

WHEN CAN YOU CLAIM: You can only claim the loss in the year you SELL the shares. If you have not sold yet, you have not incurred the loss for tax purposes. Once you sell, the LTCL can be set off against LTCG in the same year, or carried forward for 8 years to offset future LTCG.

DOCUMENTS TO KEEP:

  1. Original allotment/purchase agreement for the unlisted shares (January 2025)
  2. Proof of consideration paid: Rs 10,60,000 (bank transfer records)
  3. Demat statement showing date of credit of unlisted shares
  4. SEBI / stock exchange listing announcement for Tata Capital Financial Services (October 13, 2025)
  5. Contract note / broker confirmation for the sale (if and when you sell)
