It depends on your annual turnover and the nature of your clients.
For freelancers providing services to Indian clients:
- GST registration is mandatory if your annual turnover exceeds Rs 20 lakh (Rs 10 lakh for special category states like Manipur, Mizoram, Nagaland, Tripura)
- If you are below these limits, registration is optional
For freelancers working with foreign clients (software, design, consulting, writing):
- Your services qualify as export of services, which is zero-rated under GST
- You must register for GST regardless of turnover if you want to claim a refund of GST paid on your business expenses (ITC)
- Without registration, you pay GST on business expenses but cannot recover it
- Many freelancers earning from abroad voluntarily register even below the threshold, file nil returns for domestic supplies, and claim ITC refunds on their business spend
Additional rule: if you provide services through an e-commerce platform (Fiverr, Upwork, Toptal), GST registration is mandatory regardless of turnover under Section 9(5).
