Dear All,
One of my relative has a TDS refund claim of Rs.51,566/- which had been deducted under Section 194LA during the FY 2008-09. But unfortunately he has not filed any Return till date. So, can he claim the same amount by filling fresh return today? If "Yes" please let me know the process.

According to my knowledge it wont be allowed..!!!
get in touch with a local CA, with all facts and details, if any possiblity he will take permission from commissioner to file old return, but its not a easy task, so before going to do this he will inspect all documents and possiblities.
