Query from Indian now residing abroad

You should had filed Nil income. aLSO IF YOU HAD EARNED ANY INCOME ABROAD THAN IT WILL BE TAXABLE TILL YOU NOT BECOME nri.

SO I GUESS AT LEAST FOR THE LAST YEAR IT WILL BE TAXABLE. YOUR SALARY INCOME FROM ABROAD IF ANY.

What happens now, Can I file a nil income now, since I was studying then.

If yes, What is the procedure. If No, what are the alternatives?

File for A.Y. 10-11. there is no problem.

You may write a letter to Income tax dept that you have no taxable income it will be suffucent

u left india in 2008, it depends if u were for less than 60 days in previous year 2008-2009, 2009-2010 in india then u r non resident and as per the provision of income tax non resident is not chargeable to tax for the foreing income. furthermore if u left india for the purpose of employment to foriegn country than consider 182 days in place of 60 days for determining residential status. while going through the provision of income tax  we get one more clause that person is not required to file the return of income tax if before giving deduction his total income does not exceed more than minimum exemption slab applicable to an individual. so taking all these provision u can give a reply to the officer who has sent u the notice to file the return along with proof that u were not a resident in india and u have not earned any income in india.
