Payment of gratuity

Dear Priya it is not the company but the employee who has to complete the 5years of service in order to become eligible to receive gratuity.

From your questino it is not very clear if the company is in existence or not. 

Only in some conditions at the discretion of the company, when the employee pass away, the legal heirs can be entitled to the gratuity even before completing 5 years of continious service. But otherwise, the employee is required to complete 5 years of continuous service in the same company to be eligible for gratuity.
