Itr 4: recieved intimation 143(1)....tds related issue

Hello fellow members and expert panel........

I am a salaried professional who also has an small income from advertising business which was a one time transaction.

I had filled up ITR 4 and according to that my income from salary was about 1 lakh and profit from business was 40000 a simple one time transaction.(addition of these puts me under the non-taxable slab.........yeah....!!!)

A TDS was cut from both my salary and my business venture. Form 26 (AS) showed me the status of booking was (f).

Investments amounted to 22000 mainly LIC under section 80C

Now according to rules i am under non taxable slab hence TDS of about 8000 must be returned.

But I recieved intimation 143 (1) saying that there is no demand neither any refund.

Procedure dictates I must file a rectification but I need to confirm If I had filled up the form correctly or not. All sections in intimation 143(1) sent by It dept match my calculations except the TDS.

I double checked the TIN TAN PAN nos and all of them are in order according to form 26(A)

Could you help me out here to get back my TDS.???

Write a Letter to CPC Banglore stating the facts and demand for the Refund.

File a rectification Petition U/s. 154 stating the reason as "TDS credit not allowed even while correct feeding in e form and now reflecting in 26AS also. "

Thats it . It will solve ur problem

and as per new notification this also is not necessary .

on a salary of 1 lacs and business income 40000, how the TDS of 8000 can  be justified? please share some more details

as the salary below threshold limit of IT does not need to deduct any tax. please refurnish your details.

@ Devendra, @ rakesh:Do I need to submit anu documentation along with the rectification process??

I saw on the website that you have to upload the XML file again. Is there any official format for the rectification.??

@ U S Sharma: Absolutely right sir.......!!

But what happened was that this is my income from salary while I was working from april to july in FY 2010-2011.I left my job in august 2010.

My yearly income (April 2010 to March 2011) if I had been on the job  was suposed to be 3 lakh PA , accordingly the company had deducted the monthly TDS.

Pls check your 26AS  that TDS credit is reflecting in your 26AS and than file rectification application u/s 154 statinf the reason  as  "TDS credit not allowed even while correct feeding in e form and now reflecting in 26AS also.
