can we give gratuity even without fulfilling the conditions of number of employees.

Yes, it can be voluntarily paid. Gratuity Act stipulates mandatory provisions for organizations covered within the scope. If the employer is not covered under Payment of Gratuity Act, yet gratuity can be paid but then exemption for the purpose of income tax in the hands of recipient will be as per section 10(10)(iii)
