Dear Learned members,

In our organisation, An employee have put his papers and his last day of working is Mar-20, 2013. By this date he completes 4 Years and 9 month. Some one told him that he will be eligible to gratuity under payment of gratuity act in case completes 4 years and 6 months or more with the company.

I request member to share their views about liablity of the company to pay him grautity with reference to payment of grauity act.

Continuous service of 5 years is essential to claim Gratuity amount.as per the 'payment of gratuity act'...as the employee has not completed the desired period he can not claim Gratuity....
