Form inc-1-application for reservation of name

Hi,

We had filed form INC-1 for availing new name. The form had come for resubmission stating to mark para 14 a as yes. We had submitted the form with clarification letter that 14 a is not applicable in our case as the Company main object is commodity trading and we are not registered with any regulator like SEBI/ RBI and we are changing this name to make name of the company indicative of business of the company.

The form was rejected on the grounds that Existing name include the word CAPITAL & CREDIT indicates Finance activity, but Para 14a is not mark as yes and regulator information is not filed up.

The exisiting name contains xxx credit and capital private limited and proposed name is xxx trade private limited. Please help us to resolve the issue. and if noc is the only solution then how and to whom do we approach and what is the procedure for that.

In my opinion make a declaration note and write, that we would not carry our business unless we take approval from applicable sectoral authority (if applicable) and also approval is not required from any authority in our case and give this note on stamp paper and also get it notarised.

I have submitted declaration on stamp paper that the Company is not registered with any regulator. still the form has come under resubmission with below remark.

Existing name include the word CREDIT & CAPITAL indicates NBFC activity, which require prior approval from regulator for change of name.
